Terms of service

Who we are

Tinysurv is a customer feedback tool. Tinysurv is run by David Mitchell, a sole trader trading as Tinysurv. These terms are between David Mitchell (“we”, “us”) and you, the business that creates an account.

Email: info@tinysurv.com.

Who you pay

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

In practice: Paddle takes your payment, adds VAT or sales tax where it applies, and sends your receipts and invoices. Paddle’s own buyer terms also apply to your purchase.

Your account

  • Tinysurv is for businesses and organisations. You must be 18 or over to create an account.
  • Keep your password safe. You’re responsible for what happens in your account.
  • Use an email address you read: it’s where we send password resets and plan notices.

Plans

  • Free: no limit on responses, subject to fair use (below), across up to 3 surveys. No card needed.
  • Pro: £15 a month or £150 a year, with no limit on responses or surveys, subject to fair use (below). Pro adds the website pop-up, low-rating alerts and a weekly summary by email, PDF export, and the option to remove the Tinysurv link.

Prices include VAT for UK customers; elsewhere, any tax that applies is added at checkout. Free’s survey limit counts every survey in your account, drafts and closed ones included; if you move to a plan with a lower limit, your surveys stay, but you can’t add more until you’re under it. Surveys show a small “Made with Tinysurv” link on the thank-you screen, the pop-up and the QR code poster; on Pro you can remove it. Pro is billed in advance, monthly or yearly as you choose, from the day you subscribe, until you cancel. If we change our prices, we’ll email you at least 30 days before your next payment at the new price, and you can cancel before then.

Fair use

Unlimited responses and surveys are for normal use by one business: your own business and its locations. As a guide, that’s up to 10,000 responses a month per account, and 100 surveys on Pro. Going past either doesn’t stop your surveys, and your customers never see an error: we look at the account, and if the use looks like more than one business, or automated or abusive (for example responses submitted by a script), we’ll contact you about it. If it carries on, we may limit or suspend the account under these terms. To keep out scripts, an account can make up to 30 new surveys in a day.

Changing plan and cancelling

You can move between monthly and yearly billing at any time from Plan and billing. The change starts straight away: you pay the difference for the rest of your billing period, or it’s credited to your next payment. You can cancel at any time; Pro runs to the end of the month or year you’ve paid for. After that you’re on Free: your surveys and results stay, your surveys keep taking answers, and the Pro extras stop.

Refunds are covered by our refund policy.

Your surveys and your customers’ answers

Your surveys and the responses to them are yours. You decide what to ask and what to do with the answers, which makes you the data controller for your customers’ responses; we process them on your behalf to run the service. Our data processing agreement forms part of these terms and sets out how we do that, including the sub-processors we use. Our privacy notice says what we collect.

Please don’t use Tinysurv to ask for sensitive information (health, finances, passwords and the like), to collect answers from children, or for anything unlawful, misleading or abusive.

Public score page

On Pro you can show one survey’s score in public, on a page at tinysurv.com/r/ and as a badge. When you turn it on, you agree that:

  • you’ll share the survey with all your customers, not only happy ones;
  • you won’t answer it yourself, or ask friends or staff to;
  • if you offer anything for answering, you’ll say so on the page.

Every rating from the last 12 months counts, and ratings you delete while the page is on are counted on it. If you write your score out anywhere (on your website, in an advert), keep it current and say the period it covers, such as “Rated 4.6 out of 5 by 132 customers on Tinysurv in the last 12 months”.

If we think a score is being gamed, we may remove the page or close the account.

Using Tinysurv fairly

  • Don’t try to break, overload or get around the limits of the service.
  • Don’t submit fake responses to your own or anyone else’s surveys.
  • Don’t resell access to Tinysurv without asking us first.
  • Only add the website pop-up’s code to websites you run or have permission to change.

If an account breaks these terms, we may suspend it. We’ll tell you why, and where we reasonably can, give you a chance to put things right first.

No hate, harassment or abuse

Your surveys, questions, logos and anything else you put on Tinysurv must not promote hate or abuse. That means no:

  • Direct attacks on, dehumanising language about, or calls for violence against people because of their race, ethnicity, colour, nationality or national origin, caste, religion or belief, disability, serious illness, age, sex, gender, gender identity or reassignment, sexual orientation, pregnancy or maternity, or marriage or civil partnership.
  • Slurs, hate symbols, or claims that any of these groups are inferior or should be excluded.
  • Harassment, bullying, or targeted or coordinated abuse of anyone.

If a survey or account does any of these, we may remove the survey, suspend the account or close it. Because of the harm it can cause, we may act straight away, without a warning first, and we’ll tell you what we did and why. We may also report content to the police where the law requires it or someone may be at risk.

Keeping it running

We work hard to keep Tinysurv available and your data safe, and we take backups, but we can’t promise it will never be interrupted. We may improve or change features; if we remove something important to your plan, we’ll tell you first.

Liability

Nothing in these terms limits liability that the law doesn’t allow us to limit, such as for death or personal injury caused by negligence, or for fraud. Otherwise, we aren’t liable for indirect losses such as lost profits or lost business, and our total liability to you is limited to what you’ve paid us in the 12 months before the claim.

Ending

You can delete your account at any time from your Account page. That cancels any subscription and deletes your surveys and every response from the service straight away. Copies in our backups are deleted as the backups are replaced, within about a month; the data processing agreement has the details.

Changes and law

If we change these terms in a way that matters, we’ll email you before the change takes effect. These terms are governed by the law of England and Wales.
